An employee is obliged to use an electronic signature card

The Federal Court of Justice decided (in ruling from September, 25 2013 reference number 10 AZR 270/12) that an employee is obliged to use a signature card if it is required to perform work. The defendant must, in conjunction with his operating activities, issue invitation to tender.

This publication is only possible to be released with an electronic signature according to the Signature Act (SigG). To have an advanced electronic signature it is necessary to transmit personnel data to a certification authority. The employer asked the employee to apply in person for a signature card, he guaranteed to take over all costs and released from liability. However she refused to do so and the employer initiated legal proceedings. Both the previous instances and the Federal Court of Labour (BAG) agreed with the employer. The instruction does not violate the employee's right to informational self-determination. All personnel data are sufficiently protected by the Signature Act, as well as the employee herself due to the release of liability. Furthermore, the employer can never use the signature card to check the behaviour or measure and evaluate performance.
